This is an English translation of the Icelandic terms (Skilmálar), provided for information. The contract is made in Icelandic and the Icelandic text prevails in case of any discrepancy.
1. Seller
The Arctic Marketplace – operated by Sindri Már Bergmann Tryggvason (sole proprietor)
- Reg. no. (kennitala): 151195-3349
- VAT no.: 162990
- Address and place of business: Skógartröð 7, 600 Akureyri, Iceland
- Phone: +354 888 7299
- E-mail: info@arctic-market.com
- Website: arctic-market.com
These terms apply to purchases of goods in the online shop arctic-market.com. Sections 1–12 apply to consumer purchases. Section 13 applies to contracting services and section 14 to company products sold on the basis of a quote.
Consumer purchases are governed by the Consumer Contracts Act no. 16/2016, the Consumer Sales Act no. 48/2003 and the Electronic Commerce Act no. 30/2002. Nothing in these terms limits the rights consumers have under the law.
2. Products in the shop
The shop has four kinds of products. Each product page states which kind it is:
- Made to order (print-on-demand): The item is produced specifically to order by our print partner and shipped directly to you.
- Personalised items (“with your design”): Items produced with your name, text, image, logo or design, e.g. flags, ship flags with a boat’s name, posters and shirts with your design. After you order, you send us the design or information and we send you a proposal for approval before production starts.
- In stock: Items we have in stock in Akureyri.
- Pre-sale and imports: Items on their way to Iceland. The estimated arrival is shown on the product page.
3. Prices
- All prices are in Icelandic krónur (ISK) and include VAT.
- Prices include all public charges, also for goods that are produced abroad and shipped to Iceland (see section 7).
- Shipping is added to the price of the goods and is shown in the cart before you confirm the order. See the Shipping page.
- Prices and the product range may change, but the price that applied when you ordered stands.
- If there is an obvious error in a price, we will let you know before the order is processed. You can then confirm the order at the correct price or cancel and receive a full refund.
4. Payment
Payment is made on the secure, hosted payment page of the payment provider by card (Visa or Mastercard), Apple Pay or Google Pay. Payment is made in Icelandic krónur.
You enter your card details with the payment provider. They neither pass through nor are stored on The Arctic Marketplace website, and we never see your card number.
5. How an order works
- You choose a product, size and quantity and add it to the cart.
- In the cart you can review the order and correct the quantity or size. During checkout you enter your name, e-mail, phone and delivery address and can correct this information before you order.
- You choose a shipping method and see the total price including shipping.
- You tick the box to accept the terms, the returns policy and the privacy policy. If the order contains a personalised item, you also confirm that it has no 14-day right of withdrawal (see section 9).
- You click the button “Panta með greiðsluskyldu” (Order with obligation to pay) and are taken to the payment provider payment page.
- When payment has succeeded you receive an order confirmation by e-mail. The contract is formed with that confirmation.
We keep the order and the confirmation. If you have a user account, you can see your orders under “My account”. You can save or print these terms at any time.
The contract is made in Icelandic. The website is also published in English, Polish, German, Danish, Norwegian, Swedish, French and Spanish. The translations are for information and the Icelandic text prevails in case of any discrepancy.
6. Delivery time
- Made to order (print-on-demand): Usually 7–15 working days from the order: production 2–5 working days and shipping 5–10 working days.
- Personalised items: Production starts when you have approved the proposal. Delivery then usually takes 7–15 working days.
- In stock: Sent from Akureyri within 1–2 working days and usually delivered within 2–5 working days.
- Pre-sale and imports: Delivered when the item has arrived in Iceland. The estimated arrival is shown on the product page and we let you know when the item is shipped.
If delivery is delayed, you can demand delivery or, if the delay is substantial, cancel the purchase and receive a full refund under the Consumer Sales Act no. 48/2003.
7. Shipping, charges and risk
- The online shop ships only within Iceland. Shipping abroad is only by special agreement.
- Made-to-order items are usually produced in Europe, but sometimes in the United Kingdom or the United States. Goods shipped to Iceland from abroad are imported. All charges are included in the price, including import VAT, customs duties and the carrier’s customs handling fee. If a carrier nevertheless charges you such fees, we will refund them in full against a receipt. Send the receipt to info@arctic-market.com.
- The risk of the goods passes to you when you, or someone you designate (other than the carrier), has received them. If a parcel is lost or damaged in transit, we bear the responsibility and send a new item or give a refund.
- More about shipping methods and prices on the Shipping page.
8. Right of withdrawal (14 days)
As a consumer you can withdraw from a purchase within 14 days without giving any reason. The period starts on the day you, or someone you designate (other than the carrier), receive the goods. If items from the same order arrive separately, the period starts when the last item arrives.
You notify us with a clear statement, e.g. an e-mail to info@arctic-market.com, before the period expires. You may use the standard form on the Returns & refunds page, but this is not required.
We refund all payments received from you, including the original shipping cost (based on the cheapest shipping method offered). The refund is made without undue delay and no later than 14 days after we receive your notice, to the same means of payment you used. You pay the direct cost of sending the goods back, unless the item is defective or wrong. More on the Returns & refunds page.
9. Exceptions from the 14-day right
Personalised goods. Under Art. 18(c) of Act no. 16/2016, the right of withdrawal does not apply to goods made to your specifications or clearly personalised. In the shop this applies to goods produced with a name, text, image, logo or design that you supply, e.g. flags with your design, ship flags with a boat’s name, posters with your image and shirts “with your design” or with your logo. The product page of such goods states “Sérmerkt vara – enginn 14 daga skilaréttur” (personalised item – no 14-day right of withdrawal) and you confirm this separately before you order.
Goods printed to order with our own designs, in the sizes and colours offered, are not personalised. The 14-day right applies to them as to other goods.
Sealed food. The right does not apply to food in sealed packaging (e.g. mints) if the seal has been broken after delivery, as it cannot be returned for hygiene reasons (Art. 18(e) of Act no. 16/2016).
The exceptions do not affect your rights in respect of defects. If a personalised item is defective, wrong or damaged on delivery, we will remedy it in accordance with section 10 and the Consumer Sales Act no. 48/2003. This also applies if the produced item deviates from the proposal you approved.
10. Defects
If an item is defective, you are entitled to remedies under the Consumer Sales Act no. 48/2003: repair, a new item, a price reduction or cancellation of the purchase and a refund, and damages where applicable.
- Let us know without undue delay after you discover the defect. The period for complaints is, however, never shorter than two months from when you discovered it.
- You can rely on a defect for two years from receiving the item, or for five years if the item is intended to last considerably longer than usual.
- We are responsible to you as the seller, also when an item is produced and shipped by our production partner. You do not need to turn to anyone else.
- Send us your order number, a description of the defect and a photo if possible to info@arctic-market.com. We pay all shipping costs for defective or wrong items.
11. Privacy and cookies
We process personal data in accordance with the Act no. 90/2018 on Data Protection and the Processing of Personal Data and the General Data Protection Regulation (EU) 2016/679. See the Privacy & cookies page.
12. Disputes, governing law and jurisdiction
Purchases in the shop are governed by Icelandic law. If a dispute arises, we will first try to settle it amicably. Contact us at info@arctic-market.com or by phone at +354 888 7299.
Consumers can refer a case to the Icelandic Complaints Committee for Goods and Services (Kærunefnd vöru- og þjónustukaupa, see island.is/v/kaerunefnd-voru-og-thjonustukaupa). The Arctic Marketplace complies with the committee’s rulings.
Cases that cannot be resolved otherwise shall be brought before the District Court of Northeast Iceland (Héraðsdómur Norðurlands eystra), unless the law provides otherwise.
We may change these terms. Each order is governed by the terms published when the order was placed.
13. Contracting services
Contracting services (skippering, engine-room watch, machinery work, drone inspection and implementation of web apps) are not sold in the online shop. They are provided only on the basis of a quote. Price, scope, timing and payment are governed by the accepted quote in each case.
14. Company products and quotes (business-to-business)
14.1 Scope. This section applies when a legal entity or an individual acting in the course of a business buys branded goods, clothing packages or imported company products on the basis of a quote. Such purchases are governed by the Sale of Goods Act no. 50/2000, with the deviations set out here. Acts no. 16/2016 and no. 48/2003 do not apply to these purchases and there is no right of withdrawal (no 14-day right of return). In case of any discrepancy between this section and an accepted quote, the quote prevails.
14.2 Quotes and prices. A quote is valid for 30 days from its date, unless otherwise stated. Prices on the product pages of company products are guide prices (“from” prices). The final price, minimum quantity, branding and what is included (e.g. shipping to Iceland and import charges) are stated in the quote. A contract is formed when the buyer accepts the quote in writing (e.g. by e-mail) and the deposit has been received.
14.3 Proof. Before production starts we send a proof (mockup). Production does not start until the buyer has approved it in writing. The buyer is responsible for checking spelling, colours, size and placement of the logo. We are not responsible for errors that appear in an approved proof. Changes after approval may affect the price and delivery time.
14.4 Payment. The buyer pays 50% of the total price as a deposit when ordering and the balance before delivery, unless otherwise agreed in writing. Payment is made with a payment link from Teya. Late payment interest is charged under the Interest and Price Indexation Act no. 38/2001. The seller owns the goods until they have been paid in full.
14.5 Production variances. In custom production, the quantity delivered may vary by up to ±5% from the quantity ordered and is invoiced according to the quantity delivered. Colours on screen and in the proof may differ from printed colours and fabric colours. Minor variances in colour, size and placement of the branding, which are normal in such production are not considered defects.
14.6 Delivery. Delivery is by agreement and is stated in the quote, e.g. collection at Eimskip or shipment with the carrier offered by the supplier at the time. The delivery time in a quote is an estimate and is based on approval of the proof and receipt of the deposit. The seller is not responsible for delays caused by circumstances beyond its control, e.g. delays at manufacturers, carriers or in customs clearance (force majeure). The seller will notify the buyer without delay if delivery is delayed.
14.7 Inspection and complaints. The buyer shall inspect the goods immediately on delivery. Complaints about defects, wrong quantity or wrong goods shall be sent in writing to info@arctic-market.com within 8 days of delivery, with photos. Complaints about hidden defects, which could not be seen on normal inspection, shall be sent without undue delay after the defect is discovered. The seller is entitled to remedy a defect by reprinting or redelivering before the buyer can demand a price reduction or cancellation.
14.8 Limitation of liability. The seller’s liability for each order is limited to its purchase price. The seller is not liable for indirect or consequential loss, such as business interruption or loss of profit. These limitations do not apply if the loss is caused by the seller’s intent or gross negligence.
14.9 Logos, designs and rights. The buyer warrants that it owns, or is entitled to use, all logos, trademarks, text, images and other designs it supplies, and that production based on them does not infringe the rights of third parties. The buyer indemnifies the seller against third-party claims and costs arising from this. The seller may refuse material it considers to infringe the law or the rights of others. The buyer retains all rights to its own logos and the seller uses them only to fulfil the order.
14.10 Governing law and jurisdiction. The transactions are governed by Icelandic law. Cases shall be brought before the District Court of Northeast Iceland (Héraðsdómur Norðurlands eystra).
